Terms and Conditions for Blendscan

1. Introduction

Welcome to Blendscan, a 3D scanning and product visualization service that enables businesses and individuals to display products in 3D and in real-world environments using mobile devices.

These Terms and Conditions ("Terms") govern your access to and use of:

• the Blendscan mobile application (iOS),
• the Blendscan web platform,
• related services including 3D model hosting, AR previews, and HTML embed tools.

By accessing or using Blendscan, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Service Description

Blendscan provides tools that allow users to:

• upload existing 3D models to Blendscan servers,
• scan real-world products using a compatible iOS device to generate 3D models,
• host 3D models securely on Blendscan infrastructure,
• generate a simple HTML snippet (button or embed) to display a live 3D or AR product preview on third-party websites or e-shops,
• allow end customers to view products in their real environment using their mobile device camera.

2.1 Ways to Use Blendscan

Users may use Blendscan in one or more of the following ways:

1. Upload Your Own 3D Model
   Upload an existing 3D model to Blendscan, receive an HTML snippet, and embed it on your website or e-shop.
2. Scan Products Using the iOS App
   Scan physical products with the Blendscan iOS app, upload the generated 3D model to Blendscan servers, and embed it using the provided HTML snippet.
3. Professional 3D Model Creation (Optional)
   Users may request professional, high-detail 3D model creation from Blendscan or its partners under separately agreed commercial terms.

3. Eligibility

To use Blendscan, you must:

• be at least 18 years old or have legal guardian consent,
• have the authority to enter into these Terms,
• comply with all applicable local, national, and international laws.

4. Account Registration

4.1 Account Creation

An account is required to access Blendscan services. You are responsible for maintaining the confidentiality of your login credentials.

4.2 Account Responsibility

You are responsible for all activities that occur under your account.

4.3 Account Suspension or Termination

Blendscan reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.

5. Plans, Packages and Availability

5.1 Subscription Access

Some features of Blendscan are available through a recurring subscription (e.g. app access, scanning tools, account access).

5.2 Model Packages

Use of hosted 3D models may be subject to usage limits based on purchased model packages. Each hosted model may count toward your available quota.

5.3 Additional Services

Professional 3D model creation, custom integrations, or enterprise features may be offered separately and governed by additional agreements.

6. Pricing and Payments

6.1 Pricing

Current pricing is displayed in the Blendscan app or on the Blendscan website and may vary by region.

6.2 Billing

Payments are processed via Apple App Store, Google Play, or other approved payment providers.

6.3 Refunds

Refunds are handled according to the policies of the payment provider (Apple, Google) and applicable consumer protection laws.

7. Intellectual Property

7.1 Blendscan IP

Blendscan retains all rights, title, and interest in its software, infrastructure, interfaces, and services.

7.2 User Content Ownership

Users retain ownership of their uploaded or scanned 3D models.

7.3 License Granted to Blendscan

By using the service, you grant Blendscan a non-exclusive, worldwide, royalty-free license to host, process, display, and technically modify your content solely for:

• providing the service,
• enabling previews and embeds,
• improving product functionality,
• marketing Blendscan (unless you explicitly opt out).

8. User Responsibilities

You agree not to:

• upload content you do not have the right to use,
• upload illegal, offensive, infringing, or misleading content,
• misuse the service in a way that disrupts Blendscan or third-party systems,
• attempt to reverse-engineer or bypass service limitations.

You are responsible for ensuring that content embedded on your website complies with applicable laws and consumer regulations.

9. Service Limitations

Blendscan does not guarantee:

• perfect accuracy of 3D models,
• suitability of models for manufacturing or engineering use,
• uninterrupted or error-free operation.

Model quality depends on scanning conditions, lighting, object complexity, and device performance.

10. Disclaimer of Warranties

Blendscan is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Blendscan shall not be liable for:

• indirect or consequential damages,
• loss of revenue, profits, or data,
• third-party claims arising from use of embedded content.

Total liability shall not exceed the amount paid by the user to Blendscan in the preceding 12 months.

12. Modifications to the Terms

Blendscan may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the European Union, with specific jurisdiction determined by Blendscan's registered seat. Any disputes shall be resolved amicably or, if necessary, by competent courts within the EU.
